BidTaxi Customer App

Please read these Terms & Conditions carefully before placing a request to place a “Booking” and by doing so you agree to be legally bound by these Terms & Conditions. After you accept a bid from your chosen Driver you are entering into a contract with that Partner, and you will be bound by their terms and conditions of booking. If you do not wish to accept these Terms & Conditions you cannot place a booking through the BidTaxi App.

1. INTERPRETATION

1.1 Definitions:

“BidTaxi” Bid Taxi Limited of Command House, 14 The Green, Newport Pagnell, Buckinghamshire, MK18 0JW is a company registered in England and Wales with company number 10099666.
“BidTaxi App” The App produced by BidTaxi which the Customer uses to book the Driver for a journey.
“Booking Fee” The fee charged from time to time to the Customer for placing a booking through the BidTaxi App. These fees can be found on the BidTaxi website at bid.taxi.
“Business Day” A day other than a Saturday, Sunday or public holiday in England when banks in London are open for business.
“Customer” You as the person placing a booking for Partner services.
“Driver” A Licensed Private Hire Driver employed by or working for a Partner OR a self employed Licensed Hackney Carriage Driver.
“Fare” The sum paid by the Customer for the Partner services.
“Partner Services” The service provided by the Partner to the Customer, providing transportation to the Customer.
“Partner” The Licensed Private Hire Operator to which the Driver is associated with (whether employed or otherwise) OR self-employed Licensed Hackney Carriage Driver.
“Terms & Conditions” These terms and conditions as amended from time to time.

1.2 Interpretation:

  1. A reference to a statute or statutory provision is a reference to it as amended or re-enacted. A reference to a statute or statutory provision includes any subordinate legislation made under that statute or statutory provision, as amended or re-enacted.
  2. Any phrase introduced by the terms including, include, in particular or any similar expression shall be construed as illustrative and shall not limit the sense of the words preceding those terms.
  3. Any reference to the gender shall mean the gender referred to as well as the opposite gender.

2. BIDTAXI

  1. BidTaxi provides a technology platform via the BidTaxi App to offer a service to Customers whereby they can book through a Partner by stating the journey they wish to make.
  2. BidTaxi shall then inform up to 3 Partners with the journey information and allow an invitation to the closest Partner’s Driver to accept a bid to provide Partner Services to the Customer.
  3. BidTaxi is NOT a provider of Taxi or Private Hire services to the Customer and does not hold a licence or be held out to be an operator of Taxi or Private Hire services.
  4. BidTaxi is NOT an employer of the Driver.
  5. BidTaxi does not accept any liability for any loss as a result of the Customer placing any reliance upon any parts of the contents of the BidTaxi App and does not give any warranty as to the accuracy of any such information or content.
  6. BidTaxi shall not be liable for any loss or costs the Customer may suffer or incur as a result of any delays and it is the Customer’s responsibility to ensure that the Booking is made to allow time for collection. Further BidTaxi shall not be liable for any losses the Customer may suffer due to the Customer’s failure to allow reasonable and sufficient time for the Customer’s required journey. Any such complaints of this nature should be taken up with the Partner directly.

3. PLACING A REQUEST FOR PARTNER SERVICES

  1. The Customer must complete all the information requested by the BidTaxi App and follow the process to complete his/her request.
  2. BidTaxi cannot guarantee that a Partner’s Driver will bid for the requested journey by the Customer.
  3. BidTaxi shall inform up to 3 Partners who will in turn allocate a Driver who will be invited to accept a bid and/or be invited to bid. If more than one driver is offered a bid, then the driver may make a further lower bid. All bids shall be displayed to the Customer including information of the Driver including a photograph of the Driver.
  4. The Customer shall confirm his/her acceptance of a bid for each request for Partner Services for each journey. Once the Customer has confirmed his/her acceptance BidTaxi shall provide the Customers information to the Driver and/or Partner.

4. PERFORMANCE OF THE DRIVER

  1. The Partner requires that all their Drivers are Licensed with the same local authority for which a Partner holds a Private Hire Operators License OR a Licensed Hackney Carriage Driver who is also the Partner.
  2. The Partner requires that all their Drivers comply with the minimum standards as to the quality and level of service provided as set out below.
  3. The Partner requires that all their Drivers be covered by a licence from their local authority at all times and it is the Driver’s responsibility to ensure that he holds the relevant licence at all times.
  4. The Partner expects all their Driver’s vehicles to comply with all requirements of the law. The Driver’s vehicle must, but not limited to, be roadworthy, taxed and licences and the Driver must have hire & reward insurance at all times.
  5. The Partner requires all their Drivers to display a local authority plate or disc, as required by the relevant local authority. If this is not the case the Customer should inform the Partner by providing feedback through the BidTaxi App.
  6. The Partner requires all their Drivers to carry out regular vehicle safety inspections, including, but not limited to, daily walk around checks as set out in the guidelines of the VOSA.
  7. The Partner requires all their Drivers to keep his/her vehicle clean and tidy, internally and externally. The Driver’s vehicle should also be kept free from fumes and excessive noise and be fitted with adequate heating and ventilation systems which are maintained in good working order.
  8. Once a bid has been accepted the Partner requires their Driver to use all reasonable endeavours to ensure that the Customer is collected from the requested collection point at the time requested.
  9. The Partner requires their Driver to carry out the service with care and skill and shall show due care and courtesy towards the Customers and other road users.
  10. The Partner requires their Driver to drive their vehicle to the laws of the road.
  11. BidTaxi will not be liable if its requirements are not complied with by the Driver.
